- NDTSB will not cover damages due to negligence, tyre punctures and burst tyres, fuel errors, battery failure, lack of electricity due to forgotten turned-off electrical devices, or loss/damage to vehicle accessories.
- The renter is reminded that underbody and overhead damage is at their own risk at all times. All insurance is void if the vehicle is driven on unsealed or unmade roads or surfaces.
- All parking fees or traffic fines incurred during the rental period will be the responsibility of the renter.
- In addition to rental charges, the renter is required to provide a cash deposit as a guarantee of proper vehicle usage for the entire contract duration. This deposit will be reimbursed if no damage is reported upon return.
- In case of early contract termination, deposit will be forfeited. Cost of major physical defect (exterior/interior), summons and outstanding rental will be charged accordingly.
- Renter hereby agrees and undertakes:
- To ensure that the said Vehicle is handled and/or driven in a safe, skillful, courteous, and proper manner by the Renter and not any other person whether or not that person has or does not have a valid driving license;
- The Renter shall be fully responsible for all the damages, losses, charges, penalties, and costs whatsoever and however incurred by the Renter;
- To ensure that no alterations are made to the said Vehicle and not to remove any component unless it is immediately replaced with the same component or by the same component of the same like, quality, make and model or an improved or advanced version or quality;
- To immediately lodge police report and inform NDTSB within 24 (twenty-four) hours in the event of any accident and/or damage to loss to the said Vehicle;
- To be responsible for all operation costs of the said Vehicle including but not limited to fuel, as well as any costs of parking fines and towing expenses for illegal parking and any other summon compound issued by any law enforcement agency;
- To ensure that the said Vehicle is only used within the territory of Malaysia;
- That the said Vehicle shall not be used to ferry passengers other than only in the interior of the vehicle and shall not be used to carry any goods whatsoever;
- That the said Vehicle shall not be used in any motor race or in any competition whatsoever;
- That the said Vehicle shall not be used for any illegal or immoral purposes;
- Not to operate the said Vehicle in a negligent manner or whilst under the influence of alcohol or drugs;
- To bear the cost of the repair or restoration to its original condition in the event of any damage to the said Vehicle resulting from any act whether due to negligence, intentional act/ vandalizing act/ improper or careless use of the said Vehicle;
- To be solely liable for all parking fees, parking fines, traffic fines, penalties or summonses incurred in respect of the said Vehicle during the Term;
- To indemnify and keep the Financier and/or NDTSB indemnified at all times against all damages, liabilities, costs, expenses (including, without limitation, reasonable legal fees); claims or judgment that arise out of or results from any negligence, omission or willful misconduct of the Renter on the use and operation of the said Vehicle, and/or the Renter breach of any obligation, undertaking and terms under this Agreement;
- Not to assign, underlet, license or part with the actual possession and/or not to delegate the use of the Vehicle for any period of the whatsoever to any third party whosoever without the prior consent in writing of the :purchaser first had and obtained;
- To observe and comply with all laws, rules, and regulations affecting the use and enjoyment of the said Vehicle which are now in force or which may hereafter be enacted or laid down by any authority having power in that behalf.
